Please read these Terms and Conditions (“Terms”) carefully before using the Sooperbuddy Customer App and Sooperbuddy Rider App (the “App” or “Services”), operated by Sooperbuddy.

1. Acceptance of Terms

By accessing or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you disagree with any part of the terms, you must not use the Services.

2. General Service Description (Customer App)

  • The Sooperbuddy Customer App provides a platform for users to place orders for goods and/or food from third-party merchants/restaurants (“Merchants”) and have them delivered by independent delivery service providers (“Riders”) associated with Sooperbuddy.
  • Service Obligation: Sooperbuddy acts solely as a facilitator/aggregator. We are not the seller of the goods or food. The quality, safety, and legality of the items sold by the Merchant are the sole responsibility of the Merchant.

3. Rider App Specific Terms (for Riders Only)

  • Independent Contractor: Riders acknowledge that they are independent contractors and not employees, partners, agents, or joint ventures of Sooperbuddy.
  • Location Tracking: The Sooperbuddy Rider App requires and uses background location permission to function correctly. By accepting these Terms, Riders explicitly consent to the continuous, real-time tracking of their location, even when the App is closed or not in use, to enable job allocation, delivery tracking, and payment processing. Failure to grant this permission will render the Rider App non-functional.

4. Payment and Transactions

  • Online Payment: Sooperbuddy uses third-party payment gateway services. By making an online payment, you agree to the terms and conditions of the respective payment gateway.
  • Accuracy: You are responsible for ensuring the accuracy of all payment and order details. Sooperbuddy is not liable for orders delivered to the wrong address due to inaccurate user input.

5. Delivery and Risk

  • Delivery Time: Delivery times are estimates only and are not guaranteed.
  • Risk of Loss: The risk of loss or damage to the ordered items passes to you upon delivery.

6. User Conduct

Users (both Customers and Riders) agree not to:

  • Use the App for any unlawful purpose.
  • Harass, abuse, or harm another person, including other users, Riders, or Sooperbuddy staff.
  • Transmit any unauthorized advertising or spam.

7. Governing Law

These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any dispute arising shall be subject to the exclusive jurisdiction of the courts in Uttarakhand.

8. Changes to Terms

We reserve the right to modify or replace these Terms at any time. Your continued use of the Services after any modifications constitutes acceptance of the new Terms.
